AGREEMENT
Client, as defined above in (CLIENT DETAILS), hereby hires Abbate Entertainment Group, LLC (DJ) to provide professional disc jockey services for the event category and scheduled date, time and location defined and confirmed above in (EVENT INFORMATION).
DJ will supply professional emcee services, audio and lighting equipment including but not limited to a complete music and PA system with wired or wireless mics, DJ booth and facade, lighting appropriate to the wishes of Client, and approved music library. Client must provide a minimum of two weeks for DJ to purchase any music required for the event that is not already part of the DJ’s available library. During the event, DJ cannot utilize any online or offline streaming services (i.e., Spotify, Apple Music, SoundCloud, etc.) or external music libraries, including Client or guest cell phones, iPods, or any other music collections not owned by DJ due to copyright and licensing requirements. All final decisions on event and DJ schedule, equipment, music, and any other required services will be agreed upon with Client during included unlimited planning meetings.
Client as designated above in (CLIENT DETAILS) is the sole person with authority to give directions to DJ with respect to music selection, volume control, announcements, microphone usage by anyone other than DJ, and breaks, if any.
​DJ will require access to the venue at least 120 minutes prior to the start of the event for setup and sound check. Client will arrange for a parking space for the DJ's vehicle and pay the cost thereof, if any.
Except to the extent of compensation previously paid by Client under this contract, DJ is not responsible for the inability to perform due to accident, injury, equipment failure, or other condition reasonably beyond his/her control. DJ will supply backup equipment and/or DJs if needed to minimize this risk. While DJ will have backup systems available, if DJ experiences an equipment breakdown and is not able to finish the show, the fee will be paid on a pro-rata basis determined by the length of playing time. This will not apply in the case of damage to the DJ’s equipment that is caused by persons or incidents at the event. DJ cannot be responsible for electrical problems or power failures unless they are caused by his/her actions. DJ provides liability insurance through Insurance Canopy (policy # PLE919362-CDJA121834). A Certificate of Insurance can be provided if required by the Venue and/or Client. While this policy covers any liabilities related to DJ, Client will indemnify, defend, and hold DJ (and his employees, contractors, agents, and representatives) harmless from all actions, proceedings, claims, demands, liabilities, losses, judgments, damages, penalties, or expenses, of whatever kind, including interest, attorneys’ fees, court costs, and other reasonable costs and charges resulting from the negligence or intentional misconduct of the Client or third parties involved with or present at the event, including guest and venue staff. To cover any such claims, the Client may obtain a separate single liability insurance policy.
​In consideration for the services provided, Client agrees to pay DJ the total fee as determined by event booking category which defines Wedding DJ service fees at a flat rate of $2,000, indoor (non-wedding) events billed at $300 per hour, and outdoor (non-wedding) events billed at $350 per hour. All event booking categories require a non-refundable deposit due at the time of booking. The remaining balance due for event's DJ services will be invoiced directly and must be paid on or before the day of the event.
Payments are accepted online through the Abbate Entertainment booking service, and/or Quickbooks by check, credit, or by cash. All checks should be made payable to Abbate Entertainment Group, LLC. Failure to pay the balance due on the date of the event to DJ will subject Client to a $100.00 late fee plus interest at the rate of 5% per month on the unpaid amount.
​Booking of the requested date is not final until deposit payments are received by DJ, AND the terms and conditions of this contract are agreed upon and Client signature is received by DJ. The Client knowingly agrees to the validity of details outlined as well as the terms and conditions as outlined in this contract agreement by selecting "I agree to the terms & conditions" below and subsequently selecting the "SUBMIT" button at the bottom of this form to submit this confirmed agreement of services to the DJ.
​This Contract constitutes the entire understanding between the parties, and there are no covenants, promises, representations, or warranties other than as set forth herein. No modification of its terms will be valid unless they are recorded in a written instrument signed by both parties. In the event any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
​In the event of breach of Contract, a court may award attorney fees, court cost and related expenses to the prevailing party.
